Customer Agreement Form (CAF)

Please read the following terms and conditions carefully before signing the Customer Agreement Form (CAF) between TPC (Pvt.)Ltd. (hereinafter referred to as “TPC”) and the “Customer”.

Agreement:

TPC agrees to provide telecom and cable TV services (“Services”) as per the service plans selected by the Customer on the reverse side of this document.

Term:

This Agreement takes effect from the date the services are activated. The Customer agrees to a minimum service period of one (1) month. The Agreement shall renew automatically upon expiration unless written notice is submitted by the Customer at least 30 days prior. Early termination will result in charges equal to 30 days of service.

Rates and Charges:

Customers agree to pay in advance the applicable charges for selected service plans, including but not limited to installation fees, hardware installments, monthly service charges, and applicable taxes. TPC reserves the right to revise tariffs with 15 days’ advance notice. Unbilled usage due to technical errors remains the Customer’s responsibility.

Change of Service Plan:

Service plan changes are free if no technical changes are required at the premises. Requests must be submitted in writing by the 25th of the month to take effect the following month. Mid-month changes are not accepted.

Default:

Non-payment or breach of agreement gives TPC the right to suspend or terminate services without notice or liability. Abuse of TPC staff will also lead to immediate disconnection.

Usage Policy:

The Customer agrees not to use TPC services for unlawful activities and must comply with all applicable laws and regulations in Pakistan.

Service Availability:

TPC will strive for uninterrupted services but may experience temporary disruptions due to technical faults, upgrades, or repairs

Customer Support:

Telephonic support is provided through the Technical Assistance Center (TAC). On-site support for network issues will be provided within 48 hours, excluding holidays. Connectivity beyond the Customer Premises Equipment (CPE) is the Customer’s responsibility.

Governing Law:

This Agreement is governed by the laws of the Islamic Republic of Pakistan subject to the jurisdiction of local courts where services are delivered

Payment of Costs:

In case of default, the Customer will cover TPC legal and administrative expenses incurred to recover dues or enforce terms.

Limitation of Liability:

TPC and its affiliates shall not be liable for indirect, incidental, or consequential damages, including loss of profits, arising out of this Agreement or services provided.

Claims:

Claims are limited to the total amount paid for services. TPC is not liable for service delays or temporary interruptions.

Operating Environment:

Customers are responsible for ensuring a proper environment for TPC equipment. Claims must be made within 30 days of the issue. Hardware warranty is as per the Warranty Card.

Assignment:

TPC may assign its rights or payments under this Agreement. Customers must obtain TPC’s written consent to assign the Agreement.

Indemnity:

Customers shall indemnify TPC against any claims or losses arising from the use of services, including third-party or legal liabilities.

Extra Cabling Charges:

Standard in-premises cabling is included in the package. Any additional wiring will be billed separately.

Virus-Related Traffic:

Customers are responsible for securing their systems. Bandwidth consumed due to viruses or compromised credentials will be billed.

Inactive Phone Lines:

If landline services (POTS) are inactive for 180 days, TPC reserves the right to deactivate and reassign numbers without notice.

ONT & UPS Disclaimer:

  • Service disruptions may occur if ONT lacks proper power via home UPS.
  • TPC is not responsible for damage caused by unstable UPS systems.
  • For optimal performance, Customers are advised to use TPC’s UPS.

Miscellaneous:

  • TPC may modify or reposition TV channels or VOD content without notice.
  • TPC may send promotional content via registered Customer contact details.
  • Only requests made via registered email or mobile number will be processed.
  • TPC may suspend services or deny access at its sole discretion for violations.

This Agreement is made at on between The Professional Communication, having its registered office at Muhammadi Plaza 2nd Floor, Blue Area (hereinafter referred to as "TPC", which expression shall, where the context so permits, include its successors and assigns), of the one part,

And The customer (hereinafter referred to as the "Customer", which expression shall, where the context so permits, include their successors-in-interest and assigns), of the other part
WHEREAS, the Customer has approached TPC for the provision of a facility to purchase certain hardware items, as listed under Serial No. ____________ in Table 1, along with the respective quantities, unit prices, and monthly installment amounts specified therein;
AND WHEREAS, TPC, at its sole discretion, has agreed to provide the said facility to the Customer;
NOW THEREFORE, as part of the terms and conditions of this Agreement, the Customer shall submit a security deposit via Cheque No. __________ in favor of TPC.

Hardware Installation & Payment Policy

This document outlines the terms and conditions applicable to the Installation Agreement Form (CAF) between TPC Communication (Pvt) Ltd. (hereinafter referred to as “TPC”) and the Customer.

Payment Procedure

The customer shall provide an un-dated cheque in favor of “TPC Communication (Pvt) Ltd.” along with this agreement, equivalent to the total amount of hardware purchased. This cheque will serve as a security deposit to ensure timely payment of monthly installments and all other dues. TPC reserves the right to present the cheque for payment in the event of customer default.

  • The first installment is to be paid in cash or via cheque at the time of signing the agreement.
  • TPC will include the monthly installment amount in the customer’s bill on the 1st of each month. Payment is due before the 10th of every month along with applicable service charges per the subscribed package.

Payment Default

  • Dishonored cheques will incur a Rs.500 penalty plus applicable bank charges
  • A 2% per month payment surcharge will be levied on overdue amounts.
  • Customers must pay any overdue balance plus penalties within two (2) days of receiving written or verbal notice from TPC. Failure to comply may result in:
  • Suspension of all services
  • Hardware repossession
  • Legal action for recovery of dues

Immediate Repayment or Repossession of Hardware

TPC reserves the right to demand immediate full repayment of outstanding balances in the event of:

  • Missed installment payments
  • Bankruptcy or similar financial distress
  • Any adverse change in credit standing (at TPC’s discretion)

The customer must respond to such a demand within three (3) days of receiving written notice
If payment is not made, TPC may:

  • Repossess hardware
  • Transfer title back to TPC
  • Sell the hardware to recover dues

Customers must not obstruct TPC’s agents from repossessing hardware.TPC representatives or agents are authorized to enter customer premises to repossess the equipment. Customers may be required to sign documents facilitating repossession.All costs of repossession are recoverable from the customer. If sale proceeds do not cover outstanding dues, the customer must pay the shortfall within three (3) days of notification. TPC may block services and pursue litigation to recover any remaining balance.

Cancellation of Installment Facility

TPC reserves the right to cancel the installment facility at any time. Upon such notice, the customer must pay the outstanding amount within three (3) days.

Warranty

Unless otherwise specified, standard warranty terms and duration shall apply to all hardware provided under this agreement. three (3) days.
